Water access and trade

Searches

The Department of Water and Energy provides a service to assist in obtaining the interests held under the Water Act 1912 and/or the Water Management Act 2000 for specific parcels of land.

These searches are undertaken to advise clients (usually agents, such as solicitors, acting on behalf of a purchaser) of encumbrances or works that exist on a property for a sale that may be the subject of a conveyance. These searches may:

  • assist the prospective purchaser to evaluate the property as a commercial enterprise
  • identify any licences or approvals that may be attached to the property to be included in the sale and therefore transferred upon settlement
  • identify any charges or restrictions associated with exercising the licences or approvals attached to the property

The Department of Lands is the central agency for all searches relating to land.

The fee is to be paid by cheque made payable to the Department of Water and Energy.
